3. Booking Conditions

3.1  
 Flights can be booked via the Website, or via a licensed third party booking system or by phoning our customer services team or at the airport via our sales desk (where available).
3.2    Your Booking is confirmed when we, or a licensed third party booking system, makes a Booking for you. This Booking is then forwarded to you via email, or via a Confirmation Document where the Booking is made at the sales desk, or via a letter for your records. It is not necessary for you to reconfirm a Flight for which a Booking has been made.
3.3    Unless otherwise stated in these Flight Terms, you are not entitled to change your Booking once confirmed, except that names of Passengers or Flights (subject to availability) may be changed prior to check-in for the original Flight on payment of a fee (as set out in our "Fees and Charges" section) per passenger per Flight plus payment of any difference in fares, taxes and other applicable charges between the Booking originally made and the applicable fares, taxes and any other charges for the new Flights at the time the change is made.
3.4    Fares, all taxes and, in relation to your Flight, charges relating to your Booking must be paid in full before a Booking will be made. If such sums have not been paid in full (or appropriate credit arrangements are not made with us) when a Booking is made, we may at any time without notice prior to travel cancel the Booking.
3.5    The Fare will be payable by you regardless of whether you take your Flight for which a Booking has been made, except as provided in these Flight Terms.
3.6    A binding contract between you and us for any Flights booked, and between you and the Third Party Service Provider for any Additional Services booked, will come into existence when your Confirmation Document is emailed or posted to you.  You must check the Confirmation Document very carefully to ensure that all the details shown are correct.
3.7    Please contact us immediately if any information which appears on the Confirmation Document appears to be incorrect or incomplete, as it may not be possible to make changes later.
3.8   Following confirmation of your Booking we may contact you via email at the address provided by you. We will assume that your email address is correct and that you understand the risks associated with using this form of communication.  We will not be responsible in the event that you have not kept your email address up to date or informed us of any changes. We may also contact you by telephone or by post should we have difficulty in reaching you by email.
3.9    When you make a Booking, we will ask you for a booking name to be known as the Booker. The Booker has to be at least 18 years old and will be deemed to:
3.9.1    accept these Flight Terms on behalf of the passengers named in the Booking;
3.9.2    be responsible for receiving and relaying any and all communications/correspondence (including changes, amendments and cancellations) from us or any Third Party Service Provider concerning the Booking to all passengers named in the Booking;
3.9.3    where the Booker is not a passenger, you agree on request to provide us with the contact details of the Lead Passenger on the booking who will be contactable by us for the purposes of advising disruption events including delays and cancellations; and
3.9.4    acknowledge that the Booker has the consent of each passenger to receive any refund and, where applicable, incidental expenses or compensation due and payable under the Booking.
3.10    When a Booking is made by a third party (e.g. any booking system, another airline or a travel agent), the third party will act as the Booker and undertakes all the rights and obligations of the Booker on behalf of the passengers named in the Booking.
3.11   Fares apply only for carriage from the airport at the point of origin to the airport at the point of destination. Our Fares do not include ground transport services between airports and between airports and town terminals. Fares will be calculated in accordance with the applicable Tariff available on the date the Booking is made for the Flight or Flights concerned.
3.12   If you have booked directly or indirectly with Monarch Airlines, either through Monarch.co.uk , Monarch Airlines Contact Centre or via a Third Party, and you paid with a debit/ credit card you must be able to present that debit/ credit card at check-in. This is to assist the check-in process and to provide debit/ credit card verification.
Payments must be authorised by the cardholder named in the booking.  We withhold the right to cancel your booking without prior notice if we reasonably suspect that you or the cardholder are associated with any kind of fraudulent activity.  Such suspicion may be based on the following activities:
1)     You cannot provide, when questioned, contact information for the cardholder so that we may carry out security checks;
2)     The cardholder did not authorise the payment and claims that the booking is fraudulent;
3)     There has been previous fraudulent activity/chargebacks by you or the cardholder;
4)     Information given while booking is erroneous/inadequate/inconsistent/linked to fraudulent behaviour;

Changes to your Booking

 

3.13    If you wish to change your Flight or any passenger(s) to be carried you may do so in the circumstances provided in these Flight Terms, upon payment of the fees specified in "Fees and Charges" section. We shall not be liable to any person entitled to be carried by us or for any refund in connection with a proposed Flight if, in good faith, we provide carriage to a person purporting to be entitled to carriage or make any refund to the person entitled in accordance with these Flight Terms.
3.14    Where a passenger wishes to make a change to his/her Booking, these Flight Terms shall apply where the Booking Reference for the passenger’s Booking is for Flights only. Where any Additional Services have been purchased as part of that passenger’s Booking and the passenger would like to change any part of such Additional Services, these Flight Terms shall apply in addition to the terms and conditions of any Additional Services supplied by the Third Party Service Provider.

Flight Transfers and Charges


3.15  
  Where the Booking has been made with us, you can transfer Flights (that is, the date, the time or the route of the Flight) for an administration fee per passenger per Flight (see our Fees and Charges section), plus any difference between the original Fare paid and the lowest Fare available for the new Flight at the time the change is made. If the available Fare is lower than the original fare paid, no refund will be made. The changes must be completed more than three hours prior to the original Flight's scheduled departure time by calling customer services, or completed more than 6 hours prior to the original Flight's departure through our website.
3.16    Where the  Booking has been made by a licensed third party booking system the Flight can be transferred to another Flight but such transfer must be made through that licensed third party booking system. The changes must be completed more than three hours prior to the original Flight's scheduled departure time.
3.17    The fees for transfers made online and for transfers made through our customer service team via a Sales Desk (if available) are found in Fees and Charges section.

Name Changes


3.18  
  Names of passengers may be changed on payment of a fee (see our "Fees and Charges" section) per passenger, per Flight as long as this change is made more than three hours prior to the Flight’s scheduled departure time.  Such changes can be made either via the Website, any licensed third party booking system or by telephoning our customer service team at any time more than three hours prior to the Flight’s scheduled departure time.  Such changes can also be made by going to the airport Sales Desk (where available) at any time more than three hours prior to the Flight’s scheduled departure time. Name changes must apply to the entire trip.
3.19    Where the Booking has been made with us, changes to that Booking can only be made by contacting us.  Where the Booking has been made via a licensed third party booking system, changes to that Booking can only be made through that licensed third party.
3.20    If there is a difference between the original Fare paid or payable when the Booking is made and the applicable Fare available at the time the change is made, you will be required to pay any increase in the Fare since the original Booking was made. We will not be able to refund you if the new Fare is lower than the original Fare when the Booking was made.
3.21    The fees for name changes made online and for name changes made through our customer service team via a Sales Desk are to be found in our "Fees and Charges" section  and are charged at the prevailing rate at the time of the change.

Taxes and charges

3.22
   After payment of all Fare(s), taxes and charges for your Booking have been made, there will be no increase in Fare(s) for the date, Flight and class of services booked EXCEPT that if any government or other authority, or the operator of an airport, subsequently imposes a per passenger tax or charge, or increases the amount of any existing per passenger tax or charge, then we reserve the right to require payment of the additional tax or charge applicable to your Booking and to recover such additional taxes or charge from you by using (which use you hereby authorise) the payment card detailed on your Confirmation Form irrespective of whether Monarch has sent, or you have received, notice thereof. Monarch will, in fact, use its reasonable endeavours to ensure that you are promptly notified of any requirement for an additional payment.
3.23    The Hold Baggage allowance is 20kg per passenger (for Infants this is 10kg, provided the hold bag fee has been paid by the Infant’s accompanying adult) for which you must pay the applicable charges as set out in our “Fees and Charges” section. Excess Baggage is charged at the prevailing rate at the time of the Flight as set out in our "Fees and Charges" section.
3.24    Charges may apply for certain types of Baggage, for example, sports equipment or musical instruments. Please see our "Fees and Charges" section for more information in relation to such charges.

Cancellations - (except under Article 5 Regulation EC 261/2004 "the Denied Boarding Regulations")

3.25   
Bookings for Flights are generally non-refundable except as provided in these Flight Terms.
3.26    All refunds will be subject to the applicable laws, rules and regulations of England and Wales, as well as all European Community Regulations.
3.27    Credit card charges and/or fees are not refundable. Any taxes (other than APD) and charges levied against us directly, even if they are based on the number of passengers flown, by an airport operator are not refundable.
3.28    In circumstances where you accept an alternative to a refund, the relevant terms and conditions will apply to that alternative.
3.29    A cancellation can only be processed if notified to us more than three (3) hours prior to the Flight's scheduled departure time.
3.30    Subject to a non-refundable ticket being unused, any taxes, fees or charges levied by Government or other authority will be refunded on request, subject to an administration charge of £25/37.50 euros per refund transaction (not per passenger). Fuel surcharges, admin fees, credit card charges and passenger liability charges are non refundable.
Any refund shall be made within 7 business days for credit card or cash purchases and 20 days for cheque purchases.
3.31    A cancellation fee per passenger per Flight will be charged in accordance with the fees set out in our "Fees and Charges" section.
3.32    If your Booking has been made with us, the Booking may only be cancelled by contacting our customer services team.
3.33   If you cancel your Booking no refund will be made. Any taxes, fees or charges levied by Government or other authority will be refunded on request, subject to an administration charge of £25/37.50 euros per refund transaction (not per passenger). Fuel surcharges, admin fees, credit card charges and passenger liability charges are non refundable.  
3.34   We do not offer refunds in the event of passengers being unable to fly owing to any change in personal circumstances, including but not limited to medical grounds, except where we consider that you have satisfied the Unavoidable Events requirements described below.
3.35    We shall make a refund straight back either to the original method of payment or if the original method of payment is no longer available, a different method of payment which must also be in the Booker’s name.
3.36    A refund made to anyone presenting themselves as the Booker, via the use of the relevant Booking (including Booking Reference) or any other documentation provided by us in relation to the Booking, and whom we have no reason to believe is not the Booker, shall be deemed a proper refund and shall discharge us from liability and any further claim for a refund by the Booker or any Passenger and/or other member of the booking party.

Unavoidable Events


3.37
   We will consider at our discretion issuing a credit or a refund or changing your Booking where any Unavoidable Events have occurred, which make you unable to fly, provided that the claim and a copy of any supporting documentation (e.g.: death certificate in the case of a bereavement) is submitted to our customer services team.
3.38    All claims will be assessed entirely at our discretion. Any credit issued will be to the value of the original fare paid per passenger per Flight and can be used within the following six month period against any future Flights with us.
3.39    We strongly recommend that you obtain adequate travel insurance to cover yourself and your travel group for such circumstances.
3.40    We will endeavour to make any refund shall be made within 7 business days for credit card or cash purchases and 20 days for cheque purchases.

Flying with children and infants

Infants


3.41
   Infants MUST be accompanied by an adult aged 16+ years. In all circumstances the Booking must be made by someone who is 18 years or older.
3.42    If an adult is travelling with two Infants, one Infant must sit on the accompanying adult’s lap and the other Infant must occupy a separate seat on the aircraft next to and purchased by the accompanying adult and be seated in a suitable child car seat/restraint.
3.43    Infants under two weeks of age will not be accepted for travel.
3.44     Children aged two years or over must occupy their own seat on the aircraft for which the Fare payable will be the same as for any adult.
3.45    It is the accompanying person's responsibility to ensure that each Infant and child is adequately secured in its aircraft seat.

Children


3.46
   Children (under 16 years at time of travel) MUST be accompanied by an adult aged 16+ years. In all circumstances the Booking must be made by someone who is 18 years or older.
3.47    It is your responsibility to ensure that all children and infants on the Booking have the correct travel documentation (see paragraph 10 below).

Charter Flights

3.48
   For the avoidance of any doubt, "scheduled flights" refer to flights which contain "ZB" as the carrier reference in your Ticket and / or Confirmation Document. Where you have booked your Flight via Avro Limited, Cosmos Holidays Ltd, First Aviation Limited, or through any travel agent or licensed third party your Ticket,  and / or Confirmation Document will contain "MON" as the carrier reference and will be a "Charter Flight".
3.49    For the purposes of these Flight Terms, Charter Flights are Additional Services. As such your agreement for such Charter Flights is with the applicable Third Party Service Provider which will have its own applicable terms and conditions which will govern its products or services and you should read such terms and conditions in conjunction with these Flight Terms.


Discount Codes

3.50
   Discount codes are only valid at the time of booking. They are not applicable if flights are subsequently changed.
3.51    Discount Codes are valid on new bookings only and cannot be applied to existing bookings.
3.52    Discount is in addition to the normal internet discount of £15 per passenger per return flight in comparison to the price of booking via the phone.
3.53    No more than one discount code can be used per booking.
3.54    Discount codes are only valid for scheduled flights (ZB).
3.55    Discount codes are not applicable to infant passengers.
3.56    Discount codes cannot be used against airport taxes, charges or fees.
3.57    Where the flight base fare is less than the value of the discount, we will only be able to discount by the value of the fare, thereby giving the customer less than the advertised discount.
